     The parties agree as follows:
     THE ARTWORK: The Collector is commissioning a Graphite Pencil drawing of _________ 
     ___________________________________by the Artist. The Collector will furnish film or 
     digital photo images of subject. These will ( ), will not ( ) be returned with the finished artwork.
     RIGHT OF REFUSAL: It is the intent of this contract that the Artist create artwork for the
     Collector that the Collector will purchase. However, if, after the work is completed, and if the 
     Collector refuses the artwork, the Artist will retain the refused artwork and the nonrefundable 
     deposit, free of any claims or interest of the Collector and the Collector will owe no additional 
     fees to the Artist. Delivery charges and/or shipping cost (plus shipping insurance) is not 
     included in the agreed upon price of the artwork. Framing is not included in price of artwork. 
     Limited framing is available at extra cost.
     COPYRIGHT: Artist reserves the common-law copyright to all work commissioned by 
     Collector that are created by the Artist, including all reproduction rights and the right to claim 
     statutory copyright. No work of the Artist may be reproduced by Collector without the prior
     written approval of the Artist.
     PAYMENT AMOUNT: Fee will be based upon image size and complexity of completed 
     work and will be consistent with other comparable works by Artist at the time of this 
     agreement. Parties will agree to price in writing prior to commencement of artwork.
     PAYMENT TERMS: A nonrefundable deposit of 50% of the agreed price is required 
     before work commences. Payment in full is due upon completion of the artwork.
